this evening, or at least not in the near future. they had to stop here because they couldn't go on. in fact we talked to one driver who works for u.s. ups. he said his trip was essentially stopped cold here at nyack. >> coming back, you see here, this is the second time stopping for three hours shut down. and i finally ran out of hours, 16 hours is the total maximum time allowed. >> reporter: this man drove from reno to sacramento last night through one storm. he couldn't make it back to reno today. he has chains installed but is also driving a double trailer which caltrans wouldn't allow over the summit today. even those with chains couldn't make it over due to the icy roads. so mario was waiting for a relief driver and waiting for a ride home. >> no offense, but i guess you are tired? >> i am tired, i want to get

home, go to sleep. >> reporter: i talked to the chp today earlier about why the trucks couldn't make it over the summit. they say the snow falling so far is particular laterally -- moisture-rich. very wet snowfall, good for the ski resorts, but when it comes to traveling over the area, a lot of snow, the moisture content creates the icy conditions over the summer. where trucks that could go over easily have a hard time. the chains in effect, right now, the gold run exit all the way to the to the nevada state line. in addition to the rain and winds, we saw something we don't see often in the bay area, hail. scattered hail storms in several communities this morning, including include parting parts of san francisco and oakland.

back within minutes. the question, though, for many in the bay area is what will happen with the next storm. the storm downed a large pine tree here and took out power lines, hitting a large car as well. >> well, i woke up to a very large crash and saw slices of light out of my window. >> reporter: part of skyline boulevard was closed while pg&e removed the pole and reestablished electricity. dozens of homes were without power all day long. some had to leave home. the city of oakland tree division says there are a lot of older pine trees in the area. although they may not be dying, they could weaken with age. we talked to them about the morning's crash. >> the larger ones are starting to show signs of stress, leaning, different things are happening. >> reporter: downed power lines and trees closed three enon

kosta county was arrested after drug charges, welsh is accused of selling meth, marijuana and steroids and currently is being held in the jail in martinez. we do have a crew working on the story right now. we'll have a full report with what we learned tonight on the 10:00 news. and barring certain people at certain times from being on the streets in oakland. today they are looking at banning dozens of gang members in one neighborhood. more on the controversial properly. >> reporter: we were inside the hearing on whether or not to force several members of -- accused members of the gang here in oakland from hanging out together in the district. now the hearing was here at the alameda county courthouse and wrapped up just moments ago. the judge still has not decided whether to put the injunction in place. today, the oakland city attorney's office argued

whether or not they needed to be put in place, to stop gang members from joining together and scare the neighborhood. >> this stops them from continuing the criminal activity and the harm to the community. >> reporter: now the city attorney is seeking an injunction similar to the one already in place in north oakland. that would block 39 accused members of the gang from hanging out together off stopping them from writing graffiti, trespassing and also would set a curfew. contero is one of them on the list. in court today he denied being a gang member and said it would place an unreasonable hardship on him. the attorney said it is a blanket measure, and at this point the attorney has not proven the people on the list are gang members. >> so it is our belief they have to prove there is harm for each defendant. and so much they so far they

have not met the burden. >> reporter: the judge could rule after the hearings on wednesday, any injunction could happen after the trial date. a date has not been set. but attorneys say the issue could be decided by the end of the year. live, oakland, ktvu. and the california supreme court today agreed to rule on an issue regarding prop 8. the ninth circuit court of appeals is looking at legal standing regarding prop 8, whether or not it is unconstitutional. the governor and the attorney general would normally defend a state proposition but both have refused to do so. if the state supreme court rules that the group, protect marriage, does not have federal standing the court could dismiss the appeal and let stand the lower court ruling that the ban on same-sex

marriage is unconstitutional. and an airline employee facing felony identity theft charges in a credit card fraud scheme. 49-year-old johnson is in jail on a million bond. the investigators with the high tech task force accused johnson of skimming airline's credit card numbers' saying she used them to go on a $480,000 shopping spree at safeway stores. she worked at the stores. she is charged with stolen credit cards with a possible prison term of 48 years. and democratic lawmakers taking a page out of the republican playbook regarding business in california. in sacramento they ruled out 28,000 pages of regulatory documents to illustrate the problem. they are looking into regulations and will create a faster permit process for

people looking to expand businesses of the but republicans say they don't buy it. >> i think it is interesting after 40 years of the democratic controlled legislature, tying the job creators up in knots, we are suddenly supposed to believe they will save it. >> two republican senators also came out with deregulation bills today, but so far there is no bipartisan support for any of them. and pricing hitting a higher level in more than two years. we'll look live at interstate 80, looking slow there. the triple a fuel gauge report lists the average unleaded at 3.13 a gallon. up by about 1.20 from two years ago. here in california, the figure is up from 2.93 a year ago. and strong corporate earnings helping to lift the stock market today.

the gainers out-paced losers, 3- 1, the dow finished with a 61- point gain to close at 12,288. the nasdaq closed 21 points higher at 2825. and tonight, bardge docked in oakland. they floated it free to safety. it has been removed from the middle of the bay. it started to take on water yesterday. the captain decided to run the barge aground to keep it from sinking. they say only a gallon leaked into the water. he has not been seen for 11 days now, and police in vallejo say this disappearance is suspicious, friends and family say they haven't seen or heard from robert maas since february 5. the dog was seen on that day in the river park area of vallejo and later came home dragging the leash.

police say the fact that maas has not communitied with the family and friends is very unusual. we have an angry ocean. what the wind and an unusual alignment of the moon has to do with it. that story is full ahead. i believe the risk far out weighs the benefits. and with those words, the state of florida turned its back on plans to build high speed high speed rails, what california could gain from the move

. the state of florida today just said no to high speed rail. have experts say that move could bring a wind fall to california and give a real boost to the state's plan for a bullet train. >> the truth is that the project would be far too costly, the taxpayers and i believe the risk far out weighs the benefits. >> governor scott of florida

rejected the funds for high speed rail. governor scott said nine out of 10 bullet systems had cost over- runs and that two thirds over- inflated the passenger revenues by 65%. florida's decision leaves 2.4 billion in federal rail funds up for grabs. and experts say california could get the lion's share of that new . >> california probably will get the brunt of that, this will be a boost to their efforts. >> the governor pledged 3.6 to the efforts, but the federal transportation officials may partner with the private sector to bring high speed rails to florida. and high speed rail is on president obama's wish list, along with other infrastructure projects. on capitol hill they located for the plan, saying it is intended to improve infrastructure and help jobs grow. >> this is to help the united

states so that the major u.s. companies, small and large, will build the next plant here, not outside the united states. >> tim geithner says the president's budget includes strategies to export and open u.s. markets around the world. and the tunnel parge to get ready to dig from the oakland side soon. so far they tunneled about 9500 feet, or a fourth through the hillside. the project began a year ago, and when it is done it will add two more lanes to the tunnel. one of the concerns today about the weather is all of the big waves driven by high winds and high tides, the senator is live now along the marin county coast where the waves are moving. >> reporter: that is right, frank, this is rodeo cove, where we've seen the 12-foot

swells. they died down in the last minutes. of course the water temperatures are 52 degrees, winds are about 20, gusting to about 20-30. right now, and also this is nearing a full moon. so there was an impressive high tide, and possibly a problem this morning. this is 30 high, and what i noticed right away is how close to the highway it is getting. along san francisco's ocean beach, big waves pounded the base of the green highway, shutting down one lane with flooding. tides pushed waves even higher because the moon is now nearing the closest approach to earth, known as paragy, lasting the next two days. >> this is great, man, i love it. i know it will get clear. by the end of the day it is just great. >> reporter: big waves also hit the coast down to pacifa, with wind gusts strong enough that a surfer talked about getting on

this, when the instability moves through, you get showers driven by the rain. in the hills here, grabbing what moisture is left, giving you the downpours at times. on the bay bridge here, this is not much. i would be surprised if any of that is hitting the ground, we got wet this morning, no doubt about it. the showers ended, but tomorrow morning it will go off. the morning commute will be impacted with heavy rain, certainly a chance of thundershowers, easily you could see snow on bay area peaks, certainly hamilton. the snow at the top there as well, a as we get into the weekend things will be nicer here, so the unsettled weather continues, last night a big deal, one to two inches in many locations, heavy wind and rain, today we get the break, tomorrow morning the next winds come in. now not as big as what we saw last night. you saw that move through to

. california senator diane feinstein criticize u.s. intelligence officials for not monitoring the social networking sites during the events in egypt. at a capitol hill hearing, today feinstein said there was more information from the on- line sources than the intelligence community. >> i am not a big computer

person but i looked at facebook. and i am not a member of facebook. and you could get right in and you could see everything about it. >> senator feinstein also asked the intelligence director, james clapper, for better intelligence on the muslim brotherhood. the group was banned under hosni mubarak and is now trying to form a political party in egypt. and tonight, the numbers show that hundreds died during the recent protests in egypt. sources say at least 300 people were killed in the events. it is the first accounting of deaths from the government. however one official says this is only the preliminary count of civilian death and doesn't include police. and a judge is expected to decide later this month whether the estate of a convicted killer should be forced to pay restitution now that he is dead. edward schaffer was stabbed to death, serving 20 years to life for killing nine-year-old

melanie osheroff. he was also ordered to pay money in restitution. the public defender wants that money number thrown out. and looking at plans for construction of a new death row complex at san quentin. the county is suing to stop the project, saying that governor schwarzenegger improperly used a veto, the critics say elsewhere would be less expensive and the land on which the prison is sitting could be put to a better use. the large budda statue now is on the move. the cameras rolled as work crews began to tear down the 27- foot tall sculpture that is called three heads, six arms. the statue has been loan on china for a while now, they declined to grant an extension. it is expected to take three days to get the statue down for

. bay area news coverage continues, this is ktvu at 5:00. you're seeing what up until now only the firefighters could see in an actual fire. they had an extra pair of virtual eyes. they are experimenting with a

camera, about the size of a small cigar, mounted on a helmet. but this week, the helmet camera was used in a raging house fire. more, life, how you can see the firefighters get the view. >> reporter: the home here in east paloalto that went up in flames monday, it is where the firefighters used the helmet camera for the first time. they gave us a look so we can show you what it is like for the firefighters in a burning structure. so watch and listen. [loud noises] >> reporter: the fire captain seth johnson has the helmet camera rolling as they pull up to the house. moments later they go in to look for victims and stop the destruction. what hits you right away is firefighters are immediately plunged into darkness, caused by thick smoke. they move carefully, guided by the spots of light.

at one point they put out a hot spot in the light. captain johnson says the helmet camera video helps to tell them what they should do next time. >> the certain decisions -- asking for breathing help sooner, asking for another crew to pull a hose line. the good thing about this is it is not just visual, we get a lot of audio out of it. >> and you get to see what happens when the firefighters do run inside a burning building. and how far it is just not like it is in the movies. >> reporter: as much as the technology helped give the firefighters a boost, they say they want to see a camera this size combined with thermal imaging technology to sense the heat. >> it finds the victim, instead of searching two or three or four minutes to search, the imaging camera can scan that room in a matter of seconds. >> reporter: the fire department will continue to

test that camera, and if it continues to work well, they will order more of them. and teachers and staff in the oakland unified school district are getting a heads up that a lot of layoff notices could be on the way. a letter posted on the district's website says it could be facing more than 12.6 million in cuts in next year's budget. and the district says it plans to issue a significant number of so-called march 15th notices to staff in the coming weeks. state law requires school districts to warn employees of the possibility of being laid off by march 15th. >> and those layoff notices could only get worse in an already difficult financial situation for a lot of oakland teachers. more where the dozens of teachers are worried about foreclosure. >> reporter: these are very hard times for teachers here in oakland. not only is the school district planning on sending out hundreds of layoff notices, but

the oakland teacher's union says that at least 18 teachers are in jeopardy of losing their homes. stanley davis has been in the oakland area for years. he expects a layoff notice because of the cuts. he believes he could be reduced to part-time status. on top of that he said the bank initially sent him a notice of foreclosure. he doesn't see how he can afford the mortgage. >> it is terrible. i was trying to build up the american dream and trying, you know, to buy a house. i was trying to be a part of my community, make a really positive change. it is like a punch in the gut. >> reporter: the oakland teachers are currently working without a contract. >> people that are professionals, but they can't make enough to earn their living and pay for a home, that is a real reflection where society is going. >> reporter: this fourth and

fifth grade teacher here has been teaching in oakland for the past 25 years. the banks foreclosed on an investment home and now she says she can't retire, because if she does she can't afford her current year. >> it will be hard, i can see the rest of my life it will be hard. >> we haven't been able to say, the teachers as we would like -- it is painful to hear that. the public servants are performing the most important work there is have to suffer in this way. >> reporter: well, layoff notices will go out next month. school officers hope to know by may the amount of teachers they need to drop. and a worker accused of assaulting a toddler will have a mental evaluation. police say ramos attacked the two-year-old girl in a dollar tree store while her family shopped in the next aisle. in court, ramos pleaded not

guilty to the charges, but when he didn't respond to his attorney the judge ended the proceedings. ramos is due back in court on march 25th. and stepping up pressure today on regulators. about a dozen people rallied outside the san francisco offices of the california public utilities commission. they fought for them to remove the president, saying the agency is doing a poor job of over sight. >> thousands of people in california are getting sick from the powerful microwave radiation emissions. there have been more than 2000 formal complaints regarding the commission. and they continue to act as if there is no problem. >> all right, many counties and cities have demanded a stop to the smart meter installations. and the center for environmental health in oakland bought jewelry at styles for

less. and the tests showed some of the jewelry had metal components that had as much as 92% lead. the spokesperson said they pulled the products out of the stores now ands planned to go to the company that bought the jewelry. and a recall for 500,000 baby bassinets, made before last june, sold at wal-mart as well as other stores nationwide. there are concerns that they could collapse if they're not put together properly. 10 customers have reported them collapsing, and two new babies have suffered minor injuries, the company is offering a kit to help the consumers put together the bassinets properly. and speaking out. tonight, new information about what one man says his son suffered after a capture. and the plans to free him from prison. and the blunt message from a northern california man to

. the berkeley city council rejected a proposal to invite two guantanamo people to live in the city. there were two no votes, the

justice commission extended the officers to two of them cleared of wrong doing, but said they could be tortured if returned to their own countries. the federal law bans them from living in the united states. and son's constitutional rights hurt after the 911 attacks. at the university of san francisco today, frank linn called his son, john, a thoughtful child who converted to islam when he was 16. he went to afghanistan in 2001 to fight with the taliban. he later was captured, thrown in a basement with other prisoners and hit with hand grenades and flaming gasoline, according to his father. >> they flooded them with water -- but john was able to stand up and survive. >> john walker lind has served half of a 20 year federal

prison sentence. coming up at 10, we learn thed about the efforts to get lind released. and today, more on a homeland security agent murdered in mexico. special agent zapata and another agent was going to monterey when a gunman opened fire on the vehicle. he was killed, the other officer wounded in the leg. today, president obama offered his sympathy to the family. >> the president said no words could express the sadness of the loss of a loved one. their son served the country with honor, the president said. >> the department of justice and homeland security formed a joint task force to look into the matter and help track down the gunmen. and homeowners trying to keep burglars away from houses usually get a security system or a dog. but one sacramento man is taking a more direct action. >> 18 years ago, we were broken into. i called a sign company, they

. tomorrow marks the anniversary of a plane crash that killed three employees from tessla went it went down in a neighborhood. more from the eye witnesses on that day, just how close they came to being killed and how they're still trying to be healed. >> reporter: frank, the skies remain, it is a neighborhood where some homes were untouched. while just 20 feet away, other homes were nearly destroyed. now, beach street is still looking to heal. the sound of a tragedy, they are screams of terror on this date, february 17th, 2010. >> i just ran inside and yelled out to my daughter.

come out. because i don't know how far the flames were going to go. >> reporter: she says she screamed from her driveway that foggy morning as she looked up and saw the twin engine cessna just feet away. >> then all of a sudden, the fire explosion happened. >> reporter: today, she said she wouldn't have known what would happen. but today, we see the final resting spot of the cockpit. one woman, named heather starnes, is still shocked. >> if we would have been five seconds later we would have been hit by the cockpit. so definitely it was trauma. >> reporter: she says every now and then a plane coming from the airport flies right over the neighborhood. it is loud. >> before it was just in the back of your mind, you didn't really think about it. >> reporter: she says the neighbor's home is still

boarded up, due to some type of insurance debate. and as that happens, the house provides an image of the tragedy that impacted a number of lives. >> for me, there is the reminder of a family gone, we are not all back together, because i am always seeing that. >> reporter: three of the employees killed in the neighborhood still are looking to move forward, reporting live, ktvu. we have a live look now for you at the carnival splendor, the cruise ship in the bay for repairs. it is heading out of san francisco and down the long beach. they came here after a scary ordeal about 100 miles south of san diego. this ship lost power and was drifting in the pacific after a fire in the engine room. people in the ship were stranded for three or four days, no electricity or fresh

food. they were rescued. the ship was brought here to san francisco. three weeks of repairs and the ship is on the way to long beach and goes to mexico on february 20th. and dozens of criminal charges filed against a bay area american airlines employee. what she is accused of doing with the traveler's credit card numbers. more on the stories we're also working on. >> well, the big book stores like borders used to be a threat to mom and top stores. the new competition facing big and small book stores. and now what remains after the clutter on the san francisco streets. the new life given to the bike. coming up at 6:00. and a san francisco superintendent says he may introduce legislation requiring professional dog walkers to get a permit to take them into city

parks. scott wiener says the proposal to tighten the leash laws in and around san francisco could push more dog walkers into city parks, saying it could mean increased costs for enforcement and maintenance. he is still gathering information for the idea. okay, meet sutter, california's new first dog. he is the newest member of governor brown's family. he used to belong to the governor's sister and has spent the last two months with the governor, kind of on a trial basis. now it turns out sutter will stay. he has been spotted with the governor. governor brown apparently decided on valentine's day that he wanted to keep sutter. all right, on to the weather now, and well, the -- worst is over from last night, bill. but certainly we're not out of the woods just yet. >> yeah, we're not. and it is february, this is the kind of weather we expect. stock storms last night. none of this is out of the ordinary. this is what we get. we'll get more of it.

of that. this wave, which i'm going to show you right now moving through the bay area tomorrow morning is pretty significant. here we are tonight on the 10:00 broadcast, that is what i'm showing you, widely scattered showers. here we go into thursday morning. thursday around 7 or 8:00. going off, right. this is a wet morning, watch right there. the ban is moving through. until about noon. that is significant. short lived, but heavy downpours. that will have an impact, the morning commute is slow. your afternoon commute will have wet on the roads. not the end of the world, but a strong storm and it will be noticeable. impacting the commute. it will impact the travel to the mountains as well. and there is more lined up in the pacific. here we go, tomorrow morning, tomorrow a wild weather days where we come back in here tomorrow night. and look at the thunderstorm. look at the snow on the peaks, the hail stones, the wind gusts, the big surf. that is tomorrow, friday, more showers in the forecast. right now the weekend looks like it could be dry. and tough choices and heated words on capitol hill

the bay area today with heavy rain and hail. bursts of hail hit san francisco and oakland while other areas saw periods of heavy rain, sunny skies and even rainbows in some places. it has been a mixed bag and more wild weather is on the way. we are on storm watch tonight with live team coverage, ktvu's ken pritchett is in the sierra, where a winter storm warning is in effect. >> reporter: well, that warning is in effect. but here in placer county at the gas station it is not snowing. but i can tell you i watched them sweep the sidewalks clear of snow about an hour and a half ago. and right now it looks like there is about three quarter's of an inch on the sidewalks. they were clean, in this direction, we see interstate 80 where traffic is moving right now. chains are in effect, talk to the chp today. they said for most of the day, it was -- the interstate was full of spinouts that slowed

traffic on interstate 80. now this is interstate 80 today, a few hours ago just before the chain controls. but even here as you can see, the roads were slick. one car had too little traction and too much horsepower. those familiar with it say the traffic on interstate 80 was fairly light today. caltrans limited the trucks passing over the area. even some were struggling to crest over the peak. now most of the drivers we talked to were surprised by the storm and their need to chain up today. >> reporter: did you expect this? >> not like this no, we thought it would clear up today. we stayed over an extra day with the hope it wouldn't be this bad. but didn't work out that way. >> reporter: now there was an accident this morning, according to the chp, which shows the need to drive slowly over interstate 80 during these conditions. there was somebody on the side of the road trying to fix the chains, and
